2. Online Orders
When placing an order, you are responsible for ensuring that all information provided is accurate and complete, including your:
Submitting an order does not necessarily mean that the order has been accepted.
We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or website error, payment cannot be processed, or we are unable to fulfil the order.
If we cancel an order after payment has been received, we will provide an appropriate refund for the cancelled products.
3. Fresh Products & Availability
Many of our products are fresh, prepared to order and subject to daily availability.
While we make reasonable efforts to keep our website availability accurate, a product displayed as available may occasionally become unavailable before your order is prepared.
Where an item is unavailable, we may contact you to offer a suitable alternative, remove the unavailable item from the order and refund the relevant amount, or make another arrangement with you.
We will not substitute an item with a materially different product without your agreement.
4. Product Images & Descriptions
We make reasonable efforts to ensure that product descriptions, photographs and information displayed on our website are accurate.
However, photographs are provided for general illustration purposes. As meat and other fresh foods are natural products, the actual product may vary in size, shape, colour, marbling, fat distribution and appearance.
These natural variations are not, by themselves, considered a defect or quality issue.
5. Product Weights
Many fresh meat products are cut and prepared by hand.
Where products are sold according to an approximate weight, the final weight may vary slightly from the weight requested or displayed online because it may not always be possible to cut meat to an exact weight.
Where applicable, pricing may be adjusted according to the actual supplied weight.
By purchasing a product described as an approximate weight, you acknowledge that a reasonable variation may occur.
6. Prices
All prices displayed on our website are in Australian dollars (AUD).
Prices may change without notice.
The price applicable to your order will generally be the price displayed when the order is placed, subject to correction of genuine errors and any applicable adjustment for products sold by actual weight.
Delivery fees and other applicable charges will be displayed before checkout where applicable.
7. Payment
Payment must be made using one of the payment methods made available through our website or otherwise agreed with Butcher Shed.
Orders may not be prepared, dispatched or released until payment has been successfully processed where payment is required in advance.
We do not accept responsibility for delays caused by a payment provider, bank or financial institution.
8. Click & Collect
Customers selecting collection are responsible for collecting their order from the nominated location within the agreed collection period.
Fresh and refrigerated products should be transported appropriately and refrigerated or frozen promptly after collection.
Once an order has been collected, responsibility for appropriate transportation, handling and temperature control passes to the customer, subject to your rights under Australian Consumer Law.
9. Delivery
Customers must provide a complete and accurate delivery address and any information reasonably required to complete the delivery.
Someone should be available to receive perishable products where required.
If no one is available and the customer has authorised the order to be left in a safe location, the order may be left in accordance with those instructions where reasonably practicable.
Customers are responsible for promptly retrieving and appropriately refrigerating or freezing products after delivery.
Butcher Shed cannot be responsible for deterioration resulting from products being left unattended after delivery, an incorrect delivery address supplied by the customer, failure to retrieve an order promptly, or improper storage or handling after delivery.
This does not limit any rights you may have under Australian Consumer Law.
10. Delivery Times
Any delivery date or time provided is an estimate unless expressly stated otherwise.
We will make reasonable efforts to deliver within the nominated period, but delivery times may be affected by traffic, weather, order volumes, vehicle issues or circumstances outside our reasonable control.
If a significant delay occurs, we will make reasonable efforts to contact you.
11. Food Storage & Safety
Fresh meat and other perishable products must be stored, handled and prepared appropriately.
Customers are responsible for following appropriate refrigeration, freezing, handling and cooking practices after receiving or collecting their order.
If you believe a product is unsafe, spoiled or otherwise unsuitable for consumption, do not consume it and contact Butcher Shed as soon as possible.
12. Allergies & Dietary Requirements
Some products sold or prepared by Butcher Shed may contain or come into contact with allergens.
If you have a food allergy, intolerance or specific dietary requirement, please contact us before ordering if you require further product information.
While reasonable care may be taken during preparation, products may be prepared, cut, handled or stored in environments where other products and allergens are also present.
Customers with serious allergies should consider this when purchasing unpackaged or freshly prepared products.
13. Cancellations & Changes
Because many of our products are fresh, perishable and may be cut or prepared specifically for your order, cancellations or changes may not be possible once preparation has commenced.
If you need to change or cancel an order, please contact us as soon as possible.
We will make reasonable efforts to accommodate your request but cannot guarantee that a cancellation or amendment will be possible.
Nothing in this section limits your rights under Australian Consumer Law.
14. Returns, Refunds & Quality Issues
Due to the fresh and perishable nature of our products, Butcher Shed does not generally accept returns, exchanges or refunds for change of mind, incorrect selection or personal preference.
If there is a genuine problem with the quality, freshness, safety or accuracy of your order, please contact us as soon as possible.
We may request photographs, proof of purchase and other reasonable information to help us assess the issue.
Our separate Returns & Refunds Policy forms part of these Terms & Conditions.
Nothing in these Terms & Conditions excludes or limits your rights under Australian Consumer Law.
15. Promotions, Discounts & Coupon Codes
Promotions, discount codes and special offers may be subject to additional conditions.
Unless otherwise stated:
We may withdraw or correct a promotion where there has been an obvious error, misuse or other legitimate reason, subject to applicable law.
16. Gift Cards
Where Butcher Shed offers gift cards, vouchers or store credits, additional terms may apply, including expiry periods where permitted by law.
Gift cards cannot generally be redeemed for cash except where required by law.
17. Website Information
We make reasonable efforts to keep the information on our website accurate and current.
Occasionally, the website may contain errors relating to pricing, descriptions, availability or other information.
Where an obvious error occurs, we reserve the right to correct it and, where necessary, contact you regarding an affected order.
18. Website Availability
We do not guarantee that our website will always be available, uninterrupted or free from technical errors.
We may temporarily suspend or modify the website for maintenance, security, upgrades or other operational reasons.
19. Intellectual Property
Unless otherwise stated, the content of the Butcher Shed website, including our branding, photographs, graphics, text, product descriptions and other original material, is owned by or licensed to Butcher Shed.
You may not reproduce, distribute or commercially use our website content without our prior permission, except as permitted by law.
20. Fraudulent or Abusive Orders
We reserve the right to refuse or cancel orders where we reasonably suspect fraud, unauthorised payment activity, deliberate misuse of promotions, abusive conduct or other unlawful activity.
21. Limitation of Liability
To the maximum extent permitted by law, Butcher Shed is not responsible for loss caused by circumstances outside our reasonable control or by a customer’s failure to appropriately store, handle, refrigerate, freeze, prepare or cook products after they have been supplied.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
22. Privacy
Personal information provided to Butcher Shed will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.
Information may be used as reasonably necessary to process orders, arrange delivery, communicate with customers, provide customer service and operate our business.
23. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version published on our website at the time you place an order will generally apply to that transaction.
24. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
